Ratified on December 6, 1865, the Thirteenth Amendment abolished slavery and involuntary servitude “except as a punishment for crime.” Southern states and private companies exploited that exception through discriminatory arrests, convict leasing and forced prison labor. Black Codes made unemployment, movement and ordinary conduct grounds for criminal punishment.
